Media Services Terms

These Media Services Terms apply to media, content creation, promotional, event, partnership, and related services provided by Trevor Taylor LLC (“Trevor Taylor,” “we,” “us,” or “our”).

By purchasing, booking, approving, or otherwise agreeing to receive media services from Trevor Taylor LLC, the client (“Client,” “you,” or “your”) agrees to these Media Services Terms along with any applicable proposal, invoice, written agreement, or project-specific terms.

1. Services

Trevor Taylor LLC provides creator-led media and promotional services that may include business features, event promotion, content creation, user-generated content (“UGC”), social media content, interviews, business stories, affiliate or promotional campaigns, hosting, on-camera appearances, and other agreed media services.

The exact scope of each project will depend on the service purchased or the specific deliverables agreed upon between Trevor Taylor LLC and the Client.

Services not included in the agreed scope are not automatically included and may require an additional fee.

2. Booking and Project Confirmation

A project is not considered fully booked until the project scope, date or expected timeline, and applicable payment arrangements have been agreed upon.

For standard services purchased through the website, the description of the purchased service will generally establish the basic scope of work unless otherwise agreed in writing.

Custom projects may require additional written confirmation regarding deliverables, filming dates, locations, pricing, travel, usage rights, or other project details.

Trevor Taylor LLC may decline or cancel a project before work begins when reasonably necessary. If Trevor Taylor LLC cancels a prepaid project before providing the agreed services, amounts paid for services not provided will be refunded.

3. Payment

Unless otherwise agreed in writing, payment for standard media services is due before filming, event attendance, content creation, or other project work begins.

Custom projects may use different payment schedules as agreed before work begins.

Additional services, additional filming, additional deliverables, travel, extended event coverage, paid advertising rights, or other work outside the original scope may require additional payment.

The Client is responsible for reviewing the service description and agreed project scope before submitting payment.

4. Scheduling and Client Responsibilities

The Client is responsible for providing accurate scheduling information, addresses, access instructions, necessary permissions, relevant business or event information, and any agreed materials reasonably needed to complete the project.

The Client is responsible for ensuring that Trevor Taylor LLC has permission to film or create content at locations controlled by the Client.

If third-party permissions, venue approvals, releases, or other authorizations are required, the Client is responsible for obtaining them unless otherwise agreed.

Delays caused by missing information, unavailable locations, lack of access, Client scheduling changes, or other circumstances outside Trevor Taylor LLC’s control may affect the project timeline.

5. Filming and On-Site Time

Each service may include a general amount of filming or on-site time as described in the service listing or agreed project scope.

Significant additional filming time, additional locations, additional event attendance, return visits, or additional production requested by the Client may require an additional fee.

For event coverage, each agreed attendance period applies only to the specific date, location, and approximate coverage period agreed upon. Additional event days or attendance periods are not automatically included.

6. Creative Direction

Unless the project is specifically created as Client-controlled content or otherwise agreed in writing, Trevor Taylor LLC retains creative control over content published through Trevor Taylor’s own platforms.

The Client may provide accurate business information, important details, promotional priorities, products or services to highlight, offers, talking points, and other reasonable input depending on the service purchased.

Trevor Taylor LLC retains discretion regarding presentation, filming style, editing, wording, pacing, creative direction, and final presentation of content published through Trevor Taylor-controlled channels.

Payment for a feature, promotion, or collaboration does not purchase Trevor Taylor’s personal opinion or require Trevor Taylor to make statements he does not believe are appropriate or accurate.

7. Deliverables

Deliverables are limited to those included in the purchased service or otherwise agreed in writing.

A social media post, edited video, raw footage package, promotional appearance, event attendance period, interview, or other deliverable is only included when specified as part of the service.

Additional footage captured during a project does not automatically become an additional deliverable.

Trevor Taylor LLC is not required to provide unused footage, project files, editing files, raw footage, alternate edits, or additional content unless those items are included in the purchased service or separately agreed upon.

8. Turnaround Time

Unless otherwise agreed, Trevor Taylor LLC generally aims to complete standard edited content within approximately 3 to 5 business days after filming or after receiving all information and materials reasonably necessary to complete the project.

Turnaround times are estimates and are not guaranteed unless a specific deadline has been agreed in writing.

Large projects, event campaigns, custom productions, scheduling conflicts, technical issues, delayed Client materials, or other circumstances may require additional time.

If content is tied to a specific event, launch, promotion, or deadline, the Client is responsible for communicating that deadline before booking so availability can be confirmed.

9. Revisions

Content created primarily for publication on Trevor Taylor-controlled social media channels does not include general creative revision rounds unless otherwise agreed.

Trevor Taylor LLC will make reasonable efforts to correct material factual errors brought to our attention before publication when practical.

A factual correction is not the same as a creative revision.

Client-owned UGC or other finished content specifically created for delivery to the Client may include one reasonable revision when stated in the service description or project agreement.

Additional revisions, substantial changes in creative direction, reshoots, or requests outside the original scope may require an additional fee.

10. Publishing and Distribution

When a service includes publication through Trevor Taylor-controlled channels, Trevor Taylor LLC determines the final publishing format and applicable platforms unless otherwise agreed.

Content may be published to platforms such as Instagram, TikTok, YouTube, or other channels where appropriate.

Unless a specific posting date or duration has been expressly agreed upon, Trevor Taylor LLC does not guarantee an exact publication date or that content will remain publicly available indefinitely.

Content may be removed, archived, modified, or become unavailable in the future because of platform changes, account changes, legal requirements, business decisions, technical issues, or other circumstances.

11. Social Media Collaboration and Resharing

When appropriate, Trevor Taylor LLC may tag the Client, use collaboration features, or otherwise identify the Client in published content.

Unless otherwise agreed, the Client may organically reshare or repost content published by Trevor Taylor LLC to the Client’s own social media accounts, provided the content is not materially altered in a misleading way and Trevor Taylor is appropriately credited where practical.

The right to organically reshare published content does not automatically include ownership of the original files, raw footage, paid advertising rights, whitelisting rights, or unlimited commercial licensing rights.

12. Content Ownership

Unless otherwise agreed in writing, Trevor Taylor LLC retains ownership of original photos, videos, footage, edits, graphics, written content, and other media created by Trevor Taylor LLC.

Clients receive only the usage rights included in the purchased service or separately agreed upon.

When finished UGC or other content is specifically purchased for use on the Client’s own channels, the Client receives the agreed organic usage rights for the delivered content.

Transfer of copyright ownership is not included unless expressly agreed in writing.

13. Raw Footage

Raw footage is only included when the purchased service specifically includes raw footage or when Trevor Taylor LLC agrees to provide it separately.

Purchasing a business feature, event promotion, or other posted feature does not automatically entitle the Client to raw footage.

When raw footage is purchased and delivered, the Client may use the delivered footage for the purposes agreed upon. Ownership and additional licensing rights remain subject to the applicable project agreement.

14. Paid Advertising and Commercial Usage

Paid advertising rights are not automatically included with media services.

Content featuring Trevor Taylor’s name, image, likeness, voice, or content created by Trevor Taylor LLC may not be used in paid advertisements, boosted posts, whitelisted advertising, third-party advertising campaigns, or other paid media placements unless Trevor Taylor LLC has provided permission or those rights were included in the agreed service.

Additional usage fees may apply based on the content, campaign, duration, platform, audience, and intended use.

15. Affiliate and Promotional Arrangements

Some projects may include affiliate links, promotional codes, commissions, performance-based compensation, free products or services, or other forms of compensation.

Any commission percentage, conversion payment, tracking method, promotional code, campaign period, or other affiliate arrangement should be agreed upon before the applicable promotion begins.

Trevor Taylor LLC is not responsible for inaccurate tracking systems controlled by the Client or a third party.

Unless otherwise agreed, performance-based compensation does not replace other agreed project fees.

16. Sponsored, Paid, and Gifted Content

Trevor Taylor LLC may disclose paid, sponsored, affiliate, gifted, or other material relationships when required or appropriate.

The Client agrees not to require Trevor Taylor LLC to hide or misrepresent a commercial relationship or prevent disclosures reasonably necessary to comply with applicable advertising rules, platform requirements, or law.

17. No Guaranteed Results

Media, advertising, social media, and promotional performance can vary significantly.

Trevor Taylor LLC does not guarantee any particular number of views, impressions, likes, comments, shares, saves, followers, website visits, inquiries, leads, customers, ticket sales, purchases, revenue, attendance, conversions, or other result.

Payment is for the agreed services, time, production, content, promotion, access, or deliverables, not for a guaranteed audience response or business outcome.

Past content performance does not guarantee future performance.

18. Events

When Trevor Taylor LLC is hired to promote or attend an event, the Client is responsible for providing accurate event details and promptly communicating material changes.

Trevor Taylor LLC is not responsible for event cancellation, weather, attendance, venue issues, schedule changes, third-party conduct, or other circumstances outside Trevor Taylor LLC’s control.

Additional attendance days, extended coverage, travel, or additional promotional content may require additional fees unless already included in the agreed package.

19. Professional Production and Third-Party Creators

Certain projects may involve independent photographers, videographers, editors, production companies, venues, contractors, or other third-party professionals.

Unless specifically stated otherwise, those parties are separate businesses or independent service providers and are responsible for their own services, pricing, equipment, schedules, and deliverables.

When Trevor Taylor LLC coordinates a project involving a third party, the exact responsibilities of each party should be established as part of the project scope.

Trevor Taylor LLC does not guarantee the availability of any third-party creator or production provider unless their participation has been confirmed.

20. Travel

Standard service pricing generally assumes work within Trevor Taylor LLC’s normal Southern Utah service area unless otherwise stated.

Projects requiring significant additional travel, overnight travel, unusual transportation, admission fees, parking fees, or other travel-related expenses may require additional charges agreed upon before the project.

21. Client-Supplied Information and Claims

The Client is responsible for the accuracy of factual information, prices, offers, dates, product claims, business information, event information, and other materials supplied to Trevor Taylor LLC.

Trevor Taylor LLC may rely on information provided by the Client when creating content.

The Client agrees not to knowingly provide false, misleading, unlawful, infringing, or deceptive information for inclusion in content.

Trevor Taylor LLC may refuse to publish or may remove content containing information reasonably believed to be unlawful, materially inaccurate, deceptive, or otherwise inappropriate.

22. Cancellations, Rescheduling, and Refunds

Cancellations, rescheduling, and refunds are subject to Trevor Taylor LLC’s Refund & Cancellation Policy and any project-specific terms agreed upon before booking.

If meaningful work has already begun, including planning, filming, editing, travel, content creation, or reserved event attendance, some or all amounts paid may become nonrefundable as described in the applicable policy or agreement.

23. Exclusivity

Media services do not include exclusivity unless exclusivity is expressly agreed upon in writing.

Trevor Taylor LLC may work with, feature, promote, or create content involving other businesses, including businesses within the same or similar industries.

Any requested exclusivity period, geographic restriction, category restriction, or competitor restriction must be separately agreed upon and may require an additional fee.

24. Right to Decline or Discontinue Work

Trevor Taylor LLC reserves the right to decline or discontinue work when reasonably necessary, including in situations involving unlawful requests, harassment, unsafe conditions, deceptive information, material changes to the agreed project, nonpayment, or requests that would require misleading content or undisclosed commercial relationships.

If Trevor Taylor LLC discontinues a prepaid project without Client breach and before completing the agreed services, any refund will be determined based on the portion of work already completed and the circumstances of the cancellation.

25. Limitation of Liability

To the fullest extent permitted by applicable law, Trevor Taylor LLC will not be liable for indirect, incidental, special, consequential, or similar damages arising from media services, social media platform performance, third-party actions, Client-provided information, event circumstances, or the Client’s use of delivered content.

Nothing in these Media Services Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

26. Changes to Services or Terms

Trevor Taylor LLC may update service offerings, pricing, package structures, and these Media Services Terms from time to time.

Changes will not retroactively reduce specifically agreed deliverables for a project that has already been purchased and confirmed unless the Client and Trevor Taylor LLC agree to the change.

The current version of these terms will be posted on the website with an updated “Last Updated” date.

27. Governing Law

These Media Services Terms are governed by the laws of the State of Utah, without regard to conflict-of-law principles, except where applicable law requires otherwise.
